These Terms of Service (“Terms”) govern your use of homecourt.ph and any Club booking site running on the HomeCourt platform (e.g. yourclub.homecourt.ph), operated by JSQRD AI TECH SOLUTIONS OPC (SEC Registration No. 2026080264828-00), Butuan City, Agusan del Norte, Philippines (“HomeCourt”, “we”). By creating an account, registering a Club instance, or booking a court through the platform, you agree to these Terms. If you do not agree, do not use the platform.
These Terms don't replace a specific Club's own Terms of Service or Waiver of Liability, if it has one — that document (shown to you at checkout on that Club's site) governs your relationship with that Club as a facility, e.g. injury waivers and house rules. These Terms govern your relationship with HomeCourt as the software platform.
1. What HomeCourt is
HomeCourt is booking-management software. We provide the technology that lets a Club list its courts, accept bookings, take payments, and run Open Play, coaching and tournaments. We are not a court operator, a sports facility, or a party to the sport itself — the Club you book with is solely responsible for its courts, staff, coaches, safety, and the accuracy of what it lists.
2. Accounts
- You must provide accurate information when creating a Club instance or a player account, and keep your login credentials confidential.
- You are responsible for all activity under your account. Tell us immediately at admin@homecourt.ph if you suspect unauthorized use.
- You must be at least 18 years old, or have a parent/guardian's permission, to create an account.
3. If you run a Club on HomeCourt
- You are responsible for the accuracy of your listings (courts, rates, operating hours, coaches, tournaments) and for honoring bookings made through your instance.
- You are responsible for complying with all laws that apply to running your business, including business permits, tax obligations on your own revenue, and consumer protection laws (e.g. Republic Act No. 7394, the Consumer Act of the Philippines) toward your own customers.
- You are responsible for setting and honoring your own cancellation and refund terms toward your customers — see our Refund & Billing Policy for exactly which payments HomeCourt is, and is not, a party to.
- HomeCourt is free to run — see current pricing at homecourt.ph/#plans. Where a usage-based platform fee applies, it is billed against a prepaid balance you top up yourself; we may suspend an instance whose balance stays negative beyond the threshold shown in your own admin console until it is topped up, and reactivate it automatically once it is. This does not delete your data.
- We may suspend or terminate an instance that violates these Terms, is used for an unlawful purpose, or misrepresents itself to players — we will make reasonable efforts to notify you first, except where immediate action is needed to protect the platform or its users.
4. If you book a court as a player
- Bookings, pricing, availability, and refunds/cancellations for a specific court, Open Play session, coach session, tournament entry, or membership are between you and the Club, not HomeCourt — the Club sets its own rates and policies.
- Provide accurate contact details so the Club can reach you about your booking.
- Your platform-wide player account (used to sign into every Club) is governed directly by HomeCourt — see our Privacy Policy.
5. Payments
Read our Refund & Billing Policy in full before making or accepting a payment. In short: money you pay a Club for a booking generally settles directly with that Club, either into its own payment-gateway account or by manual methods it lists (GCash, bank transfer); HomeCourt does not hold or take a cut of that money. The one exception is the optional HomeCourt wallet feature, where enabled, and any platform fee a Club owner pays HomeCourt directly for using the software — both of which HomeCourt is a direct party to.
6. Acceptable use
You agree not to:
- Use the platform for any unlawful purpose;
- Attempt to bypass payment, security, or tenant-isolation controls;
- Scrape, resell, or reverse-engineer the platform without our written consent;
- Upload content you don't have the right to use, including copyrighted images or another business's branding; or
- Impersonate another Club, player, or person.
7. Intellectual property
The HomeCourt name, logo, and the platform's software are owned by JSQRD AI TECH SOLUTIONS OPC. A Club retains ownership of its own name, logo, and content it uploads, and grants us a license to host and display it as part of operating its booking site.
8. Disclaimers
The platform is provided “as is” and “as available.” We do not guarantee the platform will be uninterrupted or error-free, and we do not guarantee the quality, safety, legality, or availability of any Club's courts, coaches, or services — those are the Club's responsibility. Marketing statements on our website describe the platform's features and current pricing in good faith and are not a guarantee of results for any specific Club.
9. Limitation of liability
To the fullest extent permitted by Philippine law, HomeCourt is not liable for indirect, incidental, or consequential damages arising from your use of the platform, or for disputes between a Club and a player (e.g. an injury on a Club's premises, or a cancelled or unsatisfactory booking), which are matters between those two parties and, where relevant, the Club's own Terms of Service or Waiver of Liability. Nothing in these Terms limits liability that cannot be limited under Philippine law.
10. Indemnity
You agree to indemnify HomeCourt against claims arising from your misuse of the platform, your content, or your violation of these Terms or applicable law.
11. Third-party services
The platform relies on third-party services to function, including PayMongo (payments), Semaphore (SMS delivery), and Crisp (live chat, only if you accept cookies). Your use of those features is also subject to those providers' own terms.
12. Changes
We may update these Terms from time to time. We'll update the “Last updated” date above; continuing to use the platform after a change means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms will be resolved in the appropriate courts of the Philippines.
